Terms of Service
The terms for using DockFlow.
These Terms explain the rules that apply when you visit GetDockFlow.com, request a demo, create or manage a DockFlow account, subscribe to DockFlow, or use DockFlow software and related services.
1. Acceptance of these Terms
By accessing GetDockFlow.com, requesting a demo, creating an account, subscribing to DockFlow, installing DockFlow-related software, or using DockFlow services, you agree to these Terms of Service and our Privacy Policy.
If you use DockFlow on behalf of a company, operator, organization, or other legal entity, you represent that you have authority to bind that organization to these Terms. In that case, “you” and “your” refer to that organization.
If you do not agree to these Terms, do not use DockFlow.
2. What DockFlow provides
DockFlow provides software, website content, product demonstrations, customer accounts, subscription services, downloadable or installable tools, documentation, support, and related business services for tour, charter, rental, excursion, watersport, and activity operators.
DockFlow may improve, change, add, remove, suspend, or discontinue features over time as the product develops. We aim to keep the service reliable and useful, but we do not guarantee that every feature will always remain available or unchanged.
3. Business use and account responsibility
DockFlow is designed for business use. You are responsible for providing accurate account, company, billing, and contact information, keeping login credentials secure, and ensuring that only authorized people access your DockFlow account.
You are responsible for activity that occurs through your account, including actions taken by your team members, staff, contractors, administrators, or other authorized users.
You must notify DockFlow promptly if you believe your account, credentials, or connected website has been compromised.
4. Subscriptions, billing, and cancellation
Paid DockFlow services may be offered on a subscription basis. Plan details, pricing, billing frequency, included features, renewal terms, and payment timing will be shown during checkout, in an order form, in an invoice, or in another written agreement.
By starting a paid subscription, you authorize DockFlow or its payment provider to charge the applicable fees, taxes, and recurring amounts according to the plan or agreement you select.
You are responsible for keeping payment information current. Unless a written agreement says otherwise, subscription fees are non-refundable except where required by law or expressly approved by DockFlow.
You may cancel according to the cancellation process available in your account, through support, or as otherwise described in your plan or agreement. Cancellation stops future renewals; it does not automatically refund fees already charged unless required by law or agreed in writing.
5. Customer websites, bookings, and guest data
DockFlow may provide software that customers install or use on their own websites. When you use DockFlow-related software on your website to collect bookings, guest information, waivers, payments, schedules, passenger lists, messages, or operational records, you are responsible for that website and those data practices.
DockFlow does not collect or store guest booking data from customer websites on GetDockFlow.com by default. If you choose to send guest, booking, waiver, payment, or operational information to DockFlow for support, troubleshooting, onboarding, migration, or another approved purpose, you are responsible for ensuring that you have the right to do so.
You are responsible for your own website terms, privacy policy, cookie notices, booking disclosures, refund policies, waiver language, safety notices, payment disclosures, taxes, permits, licenses, and other legal or operational requirements that apply to your business.
6. Software license and restrictions
Subject to these Terms and any applicable paid plan, DockFlow grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use DockFlow software and related materials for your internal business operations.
You may not:
- copy, resell, rent, lease, sublicense, or commercially exploit DockFlow except as expressly allowed;
- reverse engineer, decompile, bypass technical limits, or attempt to extract source code except where law expressly allows;
- remove ownership notices, branding, security controls, or license checks;
- use DockFlow to build, train, or support a competing product or service;
- interfere with DockFlow systems, infrastructure, security, or other customers.
7. Acceptable use
You agree not to use DockFlow to:
- violate laws, regulations, contracts, intellectual property rights, privacy rights, or security requirements;
- send spam, deceptive messages, unlawful marketing, malware, or harmful code;
- misrepresent your business, pricing, availability, policies, services, or guest experience;
- collect information without required notices, consent, authority, or legal basis;
- abuse, overload, scrape, scan, attack, or disrupt DockFlow or related systems;
- use DockFlow for unlawful, unsafe, fraudulent, abusive, or deceptive operations.
8. Your content and feedback
You keep ownership of content, data, materials, logos, copy, images, messages, files, and information you provide to DockFlow. You grant DockFlow the rights needed to host, process, display, transmit, support, secure, and operate the service for you and your authorized users.
If you send ideas, suggestions, feedback, or improvement requests, you allow DockFlow to use them without restriction or compensation. This helps us improve the product while avoiding uncertainty about future features.
9. Third-party services
DockFlow may work with third-party services such as hosting providers, payment processors, email tools, analytics providers, website tools, integrations, or customer support systems. Third-party services may have their own terms, privacy policies, fees, limitations, and availability.
DockFlow is not responsible for third-party services that we do not control, including customer-selected plugins, hosting environments, payment providers, themes, WordPress configurations, or external integrations.
10. Support, updates, and early-stage product development
DockFlow is an evolving product. Some features may be new, experimental, in beta, limited, or subject to change. We may provide updates, fixes, improvements, documentation, and support at our discretion or according to your plan.
You are responsible for maintaining your website, hosting environment, WordPress installation, theme, plugins, backups, access permissions, and any other systems outside DockFlow’s direct control.
11. Compliance and operational responsibility
You are responsible for your business operations, including guest safety, activity rules, staff decisions, scheduling decisions, cancellation policies, refunds, taxes, waivers, insurance, licenses, permits, local regulations, accessibility obligations, consumer disclosures, and payment obligations.
DockFlow is software. It does not provide legal, tax, accounting, insurance, safety, employment, payment compliance, or regulatory advice. You should consult qualified professionals for those matters.
12. Intellectual property
DockFlow, GetDockFlow.com, the DockFlow name, logos, design, software, interfaces, code, visual systems, content, documentation, and related materials are owned by DockFlow or its licensors and are protected by intellectual property laws.
These Terms do not transfer ownership of DockFlow intellectual property to you. You may use DockFlow only as allowed by these Terms, your plan, and any written agreement.
13. Confidentiality
During demos, onboarding, support, or business discussions, either party may share non-public information. Each party agrees to use reasonable care to protect confidential information and to use it only for the relationship with DockFlow, unless disclosure is required by law or authorized in writing.
14. Disclaimers
To the fullest extent permitted by law, DockFlow is provided “as is” and “as available.” We do not promise that DockFlow will be uninterrupted, error-free, perfectly secure, compatible with every website setup, or able to meet every business requirement.
DockFlow does not control customer websites, customer operations, guest conduct, weather, availability, staff performance, payment providers, third-party systems, or real-world activity conditions.
15. Limitation of liability
To the fullest extent permitted by law, DockFlow will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost bookings, lost data, business interruption, reputational harm, or substitute services, even if we were advised that those damages were possible.
To the fullest extent permitted by law, DockFlow’s total liability for any claim related to the service will not exceed the amounts paid by you to DockFlow for the affected service during the three months before the event giving rise to the claim, or one hundred U.S. dollars if you have not paid DockFlow.
16. Indemnification
You agree to defend, indemnify, and hold DockFlow harmless from claims, damages, losses, liabilities, costs, and expenses arising from your business, your website, your content, your data, your guests, your activities, your breach of these Terms, or your violation of law or third-party rights.
17. Suspension and termination
DockFlow may suspend or terminate access if you fail to pay fees, violate these Terms, create risk for DockFlow or others, use the service unlawfully or abusively, or if suspension is needed to protect security, legal compliance, or service integrity.
You may stop using DockFlow at any time. Some obligations survive termination, including payment obligations, confidentiality, intellectual property rights, disclaimers, limitation of liability, indemnification, and any provisions that by their nature should continue.
18. Governing law
Unless a separate written agreement says otherwise, these Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
Any dispute that cannot be resolved informally will be handled in the state or federal courts located in Delaware, unless another venue is required by applicable law or agreed in writing.
19. Changes to these Terms
DockFlow may update these Terms as the website, product, business, or legal requirements change. When we update the Terms, we will update the “Last updated” date above. Material changes may be communicated through the website, product, email, or other reasonable channels.
Your continued use of DockFlow after changes become effective means you accept the updated Terms.
